The Consumer Financial Protection Bureau (CFPB)’s announcement last week that it intends to consider discriminatory conduct an “unfair” act or practice represents a significant expansion of the Bureau’s authority to address unfair, deceptive, or abusive acts or practices (UDAAPs). Most notably, the Bureau is directing its examiners to treat any discriminatory conduct by a supervised entity in connection with offering or providing consumer financial products or services, whether or not covered by fair lending laws such as the Equal Credit Opportunity Act, as a possible “unfair” act or practice to which Bureau’s UDAAP authority applies.
