As vaccination rates rise, the public health risk posed by COVID-19 is thankfully abating. But, the vaccines may result in an unexplored side effect: employer legal headaches. Ballard Spahr partners Louis Chodoff and Denise Keyser will discuss what they’ve seen to date. Can and should employers require employees to be vaccinated? Answer: it’s complicated. While vaccination policy leads the news, they’ll explore many other employer considerations for reopening physical office spaces. Careful planning will help protect against varied and numerous employee lawsuits, including claims related to remote work and leave, retaliation, discrimination, wage & hour, workplace safety issues, and WARN Act violations, among others.

Louis and Denise will be joined by Rowan University General Counsel Melissa Wheatcroft, who will provide an inside look at how employers, including institutions of higher learning, are mitigating risk in an uncertain legal environment. The panel will conclude with its predictions about and recommendations to protect against the next wave of COVID-19 litigation.
