Joseph J. Bailey represents clients across industries in complex commercial litigation, internal investigations, and corporate governance matters. Joe has experience in cases involving breach of contract, trade secret misappropriation, consumer protection, antitrust, securities, employment law, constitutional claims, the Americans with Disabilities Act (ADA), and the Individuals with Disabilities Education Act (IDEA). He has also conducted sensitive investigations stemming from government regulation and enforcement, lawsuits, whistleblowing, shareholder demands, and other allegations of wrongdoing.

Joe has litigated extensively in both state and federal court, including the Eastern District of Pennsylvania, the Pennsylvania Commonwealth Court, the Pennsylvania Superior Court, the Pennsylvania Court of Common Pleas, the Orphans’ Courts of Pennsylvania, the Superior Court of Delaware, the Delaware Court of Chancery, the Southern District of New York, New York Supreme Court, the Northern District of California, the Northern District of Iowa, and the Florida Circuit Court.

Representative Experience 

Representative Matters

  • Represented two large state agencies in a putative class action involving constitutional claims, as well as claims brought under the ADA and IDEA. Successfully opposed the plaintiffs’ motion to certify a class.
  • Defended a large pharmaceutical company in a breach of contract action brought by a former executive located in China. The case involved extensive international discovery. The court granted summary judgment for Ballard’s client on all claims.
  • Obtained dismissal of consumer protection claims against a large student loan servicer in first-of-its-kind federal multidistrict litigation.

Pro Bono Experience

Joe regularly represents individuals seeking a guardianship appointment from the Orphans' Court of Pennsylvania. Joe has also assisted pro bono clients in Orphans' Court matters involving the public trust doctrine, Pennsylvania's Donated or Dedicated Property Act, Pennsylvania's Inalienable Property Act, and decedent's remains.
