Ellie Perka is ranked as one of the top construction lawyers in Washington. Her entire practice is devoted to representation of public entities, contractors, developers, and institutions in all phases of construction projects. She has assisted clients in resolving disputes on small, private projects and also on many of the Pacific Northwest’s largest and most notable construction projects, including the Alaskan Way Viaduct Replacement / SR 99 tunnel project; the $350 million project to replace Seattle's timber seawall; and the $2 billion Washington State Convention Center expansion project. Outside the Pacific Northwest, she has also litigated high-stakes bid protest issues in the U.S. Court of Federal Claims, represented construction industry clients in multiple private arbitrations across the United States, and served as lead counsel in a dispute concerning the Skyline rail system in Honolulu, the largest public infrastructure project in Hawaii.
With her strong litigation background, Ellie is also skilled at drafting and negotiating complex construction contracts, with an eye toward protecting her clients’ interests and avoiding disputes. Representative Matters
- Represented protestor in $800 million bid protest at the Government Accountability Office (GAO) and appeal at the U.S. Court of Federal Claims which included substantial motions practice and a highly-contested hearing implicating then President Trump's national emergency declaration on the Southern Border.
- Represented city in King County, Washington in litigation against major utility companies for reimbursement of increased construction costs and utility-caused delays.
- Represented partnership of two port districts in $30 million+ dispute with marine contractor concerning delays, damages, and impacts, including liquidated damages, on a large-scale renovation project aimed at upgrading the terminal and berths to accommodate larger cargo ships.
- Successful defense of contractor against more than $50 million in alleged delay and increased construction costs in AAA Arbitration regarding explosion during a hospital expansion project; panel awarded client entirety of its requested contract balance, change orders, and attorneys' fees.

Pro Bono Experience
In addition to her litigation practice, Ellie is a strong advocate for the rights of women and children, including women’s advancement in the construction industry. To that end, Ellie led a consortium of firms in challenging Washington State Department of Transportation’s exclusion of women-owned construction companies from Washington’s Disadvantaged Business Enterprise program. After threat of litigation, WSDOT changed course and reinstated women-owned firms into the program.
