Andrew Gust is a Litigation associate focused on commercial litigation and dispute resolution. Before joining Ballard Spahr, he worked in the New York office of a Chambers-ranked law firm, handling complex disputes involving breach of contract, negligence, trade secrets, trademarks, product liability, fiduciary duty, and employment matters. He has litigated nationwide in state and federal courts as well as private arbitrations. His clients have ranged from startups and family businesses to high-net-worth individuals and public companies with billion dollar market capitalizations.

Andrew believes an attorney’s role goes beyond preparing to win at trial—it requires consistently positioning clients for the best possible resolution at every stage of the case. He approaches each motion, discovery dispute, and deposition as an opportunity to strengthen his client’s position. Recognizing that every case evolves differently, Andrew emphasizes the importance of adapting strategies as facts and circumstances develop.

  • Defeated both a Temporary Restraining Order (TRO) and a subsequent injunction request in the Supreme Court of New York, New York County, allowing a billion dollar go-public transaction to proceed
  • Led the resolution of multiple matters connected to a software licensing dispute, securing a settlement for less than seven figures—despite the contract being valued at more than five times that amount
  • Won summary judgment in a trade secret and trademark case, earning a “prevailing party” designation for the client, as defendants, and the right to seek over $1 million in attorneys’ fees
