DOJ Brain Drain Hampers Push to Speed Benefits Fraud Lawsuits

Bloomberg Law spoke with Henry E. Hockeimer, Jr., Practice Leader of Ballard Spahr's White Collar Defense and Investigations Group, about the Department of Justice's (DOJ) recently issued memorandum detailing a new fast-track process for triaging False Claims Act whistleblower complaints. However, the current staffing limitations at the DOJ threaten this process being put into practice.
Hank said that the DOJ's plan is "ambitious" given the recent "exodus of lawyers," and that the department's evaluations of whether to intervene in a whistleblower suit "have historically been made by seasoned prosecutors."
