Fintech was one of the hottest market segments for investors during the business-friendly Trump era and remains so under the Biden administration. However, the regulatory landscape is rapidly changing and investors must understand and evaluate the heightened risks associated with fintech companies. New leadership at the Consumer Financial Protection Bureau is already ramping up enforcement activity. Additionally, Congress has expressed its disapproval of certain fintech-friendly policies of the previous administration, and other state and federal authorities are poised to have a potentially less friendly approach to fintech companies in the months and years ahead.

In this webinar, we will provide an overview of the fintech regulatory landscape and risks you need to consider before investing in the space. We will highlight issues arising under the numerous federal and state laws that fintech companies often navigate, such as laws dealing with fair lending, privacy, usury, licensing, and anti-money laundering. Key topics include:

  •   Consumer Lending and the use of data aggregation, alternative data and artificial intelligence in customer acquisition, underwriting, and servicing
  •   Buy Now Pay Later and other emerging point-of-sale (POS) products
  •   B2B Lending, including state licensing and new California and New York disclosure requirements
  •   Digital Payments and money transmitter and anti-money laundering obligations
  •   The Future of Neo Banks and Fintech-Bank Partnerships under increased federal and state regulatory scrutiny
  •   Earned Wage Access, Income Share Agreements, Litigation Finance and other Cutting-Edge Products, including whether and how these fit into traditional lending regulations

This program is open to Ballard Spahr clients and prospective clients. There is no cost to attend. This program is not eligible for CLE credits.
