Prosecuting Insider Trading in the AI Era

David L. Axelrod and Lauren Engelmyer, both partners in Ballard Spahr's Litigation Department, wrote for Business Law Today about how the ever-evolving AI industry has impacted insider trading and subsequent prosecution. A query that results in analysis which supports buying a certain stock, for example, could be used as a defense against accusations of trading with material nonpublic information, or MNPI.
