Among Law360's Midyear Report of the biggest employment decisions of 2018 is the Janus v. AFSCME case. The justices ruled 5-4 that public-sector unions can no longer require workers to pay membership fees as a job requirement. The justices found public union's activities to be inherently political, making required membership fees for even non-members a violation of First Amendment rights.

While long-term experts foresee more individuals opting out of public union membership and subsequently reducing available union funds, Ballard Spahr Partner Steven Suflas said the most immediate effect of the case will be that all public-sector unions will "have to recruit." Suflas says they are likely "to go out and lobby people on the reasons why they should be full-fledged, dues-paying members."
