• Represented multinational beverage manufacturer in a nine-figure purchase price adjustment dispute with its largest competitor
• Represents toy, drone and water quality instrument manufacturers in license agreement and inventor agreement disputes regarding rights to technology
• Represents prominent craft brewery in trademark disputes and in a variety of business and contract disputes with competitors and vendors
• Defended a medical device manufacturer in cases involving protection of trade secrets for groundbreaking technology and defense of breach of warranty claims

Intellectual Property, Data Security and Non-compete Agreements

• Represents a wide variety of companies in cases involving former employees wrongfully competing or improperly taking the company’s intellectual property. Obtained injunctions requiring employees to return and not use intellectual property and preventing the employees from competing. Achieved successful result against company’s two former employees for breaking into the company’s computer system and taking and deleting files for violations of the Stored Wire and Electronic Communications and Transactions Access Act, the Computer Fraud and Abuse Act misappropriation of trade secrets and civil theft.
• Represented the victim company in criminal case against foreign nationals for stealing trade secrets
• Represented a national franchise in cases involving breaches of franchise agreement and trademark and trade dress infringement

Business Disputes

• Defeated a $4.3 million fraud claim against a dentist by his former business partner. After the trial, the Court agreed that the plaintiff failed to prove any damages and that his damage theories were not reliable.
• Obtained judgment against the seller of a business for fraudulent inducement
• Represented an alternative energy company in connection with a U.S. Securities and Exchange Commission’s investigation for fraudulent activities
• Defeated motion seeking to enjoin a company from moving or spending its assets pending judgment

Appeals

• Drafted amicus curiae briefs for energy trade associations for cases before the U.S. Supreme Court, the 10th Circuit Court of Appeals, and the Colorado Supreme Court.
• Worked on a successful appeal to the Colorado Supreme Court for a declaration that a county ordinance banning certain mining operations was preempted by state law
