Alejandro Monarez focuses his practice on expanding economic opportunities, establishing thriving communities, and building homes for the unhoused. He brings his legal and business perspective to make every transaction successful and has assisted with and completed many involving the Low-Income Housing Tax Credit (LIHTC) program, the New Markets Tax Credit (NMTC) program, the Rental Assistance Demonstration (RAD) program, the Choice Neighborhoods Implementation program, and other federal, state, and local sources of subsidy. He has also provided counsel on related matters including Qualified Allocation Plans, post-year 15 considerations, property tax exemption, Section 42 Right of First Refusal agreements, and preservation of affordability issues, as well as the burgeoning development of middle-income housing.
Alejandro has experience drafting, negotiating, and reviewing restrictive covenants, extended use agreements, bond regulatory agreements, loan agreements, deeds of trust, subordination agreements, purchase and sale agreements, commercial and rooftop lease agreements, contracts with vendors, ground leases, organizational documents, and intergovernmental agreements. He has also worked with public-private partnerships to create statewide grant and loan funds in response to the COVID-19 pandemic.

- Represents Fulcrum Communities, a Colorado nonprofit, as borrower's counsel in a groundbreaking 501(c)(3) tax-exempt bond transaction. This Pilot project facilitated the acquisition of a 3-bedroom townhouse in Parker, Colorado, aimed at providing affordable housing to middle-income tenants. Fulcrum's innovative approach leveraged tax-exempt bonds issued by Colorado Housing and Finance Authority (CHFA) to efficiently acquire and lease housing units to individuals earning between 80 and 120 percent of the area median income, thus addressing a critical shortage in the state. The project involved navigating complex legal challenges, including first in the state of Colorado, to demonstrate that providing middle-income housing aligns with Fulcrum's mission to lessen governmental burdens.
