Delaware Litigator Elizabeth S. Fenton Joins Ballard Spahr

March 7, 2022

Elizabeth S. Fenton—a litigator with more than two decades of experience in Delaware state and federal courts, as well as in state and federal courts across the nation—has joined Ballard Spahr as Partner in the Litigation Department, firm Chair Mark S. Stewart announced today.

Ms. Fenton is resident in the firm’s Delaware office and is a member of the firm’s Securities Enforcement and Corporate Governance Litigation and White Collar Defense/Internal Investigations Groups.

“We are very excited about Beth joining us,” said Litigation Partner David J. Margules, a 35-year veteran of the Delaware courts. “Beth is a respected litigator who raises the visibility of our practice, particularly in the Superior and Federal Courts, and adds to our Chancery bench strength. She brings a creative approach our clients will appreciate.”

Ms. Fenton joins an office with an established Chancery and corporate governance practice, as well as broad experience in general litigation, bankruptcy and insolvency, white collar criminal defense and investigations, capital finance, and consumer financial services. Her arrival supports Ballard Spahr’s commitment to expanding the firm’s capabilities in one of the most critical business litigation and entity formation forums in the country, the Delaware Court of Chancery. She also will enhance the firm’s strength representing clients before Delaware’s Superior Court and in the federal District Court.

Ms. Fenton represents clients ranging from emerging companies to Fortune 50 corporations in industries including information technology, financial services, and life sciences. Her work has involved business torts, shareholder and post-closing disputes, antitrust issues, instances of piercing the corporate veil, and enforcement of restrictive covenants.

Beyond the Delaware Court of Chancery, Ms. Fenton has first-chaired trials, arbitrations, and mediations before the Delaware Superior Court and Philadelphia Court of Common Pleas Commerce Program, and has litigated numerous private arbitrations. In addition, Ms. Fenton has led internal investigations involving allegations of ethics violations for publicly traded companies, and she has managed remediation and compliance processes.

“Throughout my career, I’ve prioritized developing strong relationships and becoming a go-to ally for my clients,” Ms. Fenton said. “Ballard Spahr has the resources of a national firm, a reputation for excellence in corporate governance litigation, and a robust Delaware practice. It provides a greater level of service for my clients, and I’m excited to join the team.”
