Nicholas Spear is an associate in the firm’s Real Estate Department, focusing on commercial real estate and finance transactions. Nick has represented various real estate clients, including publicly traded net-lease REITs and has experience with syndications, acquisition/disposition of commercial real estate, and large multi-family developments, loan closings, title and survey reviews, and mergers and acquisitions.
Nick has advised clients on a variety of real estate issues including matters relating to breach of contract, construction defects, HOA, landlord-tenant disputes, boundary disputes, adverse possession, and water rights.
Nick is also involved in the management of distressed assets. On this front, Nick frequently supports litigation counsel in handling various types of restructuring transactions, including real estate and finance related agreements. Nick actively manages the distressed asset portfolios of various clients and is involved in the repossession and repositioning of properties throughout the country.

- Represented a leading provider of food service and other resources in a breach of contract dispute
- Represented an opportunistic real estate fund in its efforts to acquire, develop, lease, and finance stand-alone health care and education facilities in Phoenix to serve its target communities
- Represented a New-York based institutional investor in the 2022 acquisition of a multi-building charter school facility
