Agentic artificial intelligence—AI systems that can act autonomously, initiate decisions, and interact directly with consumers—is rapidly moving from experimentation to deployment in consumer financial services. These developments raise fundamental questions about whether existing consumer protection, fair lending, and regulatory frameworks are equipped to address increasingly autonomous systems.

The webinar will open with a framing presentation by Professor Oren Bar-Gill, who will situate agentic AI within the broader evolution of algorithmic decision-making in consumer markets. Drawing on his scholarship on algorithmic differentiation and consumer harm, including Algorithmic Harm: Protecting People in the Age of Artificial Intelligence (co-authored with Cass Sunstein), Professor Bar-Gill will explore whether agentic AI represents a fundamentally new legal challenge or an intensification of existing doctrinal stresses around consent, disclosure, accountability, and market power.

  • What distinguishes agentic AI from traditional automation and generative AI
  • Real-world and near-term use cases in consumer financial services
  • How agentic AI challenges existing legal frameworks, including:
    • Attribution of decisions and liability
