The recently enacted GENIUS Act (Governmental Examination of Novel Instruments and the U.S. System Act) creates the first comprehensive federal regulatory framework for stablecoins—digital assets tied to the value of the U.S. dollar or other reference instruments. The statute has significant implications for banks, fintech companies, crypto-native platforms, and their legal advisors.

This webinar will provide a practical and legal analysis of how the GENIUS Act reshapes the regulatory landscape for the issuance, distribution, and supervision of stablecoins. Our expert panel will explain what the new requirements mean, identify key areas of uncertainty and risk, and offer guidance for both compliance and innovation.

We will be joined by the following guest speakers:

  • Arthur E. Wilmarth, Jr., Professor Emeritus, The George Washington University
  • Richard Rosenthal, Principal, Risk & Financial Advisory, Deloitte & Touche LLP

Topics to be discussed include:

  • Key provisions of the GENIUS Act: licensing, oversight, and enforcement
  • Federal vs. state jurisdiction: preemption of state stablecoin regimes

  • Role of federal banking regulators: OCC, Federal Reserve, and FSOC

  • Legal risks, key issues and constitutional challenges already surfacing.

  • Business model impact including role of tokenized deposits: implications for fintechs, banks and other market participants

  • Compliance roadmaps and operational readiness strategies

  • Opportunities for privately-owned and publicly traded Big Tech firms and other commercial enterprises to acquire stablecoin issuers and enter the banking business
