As a follow-up to our July 21 Legal Alert, Bill 15-23 was passed by Maryland's Montgomery County Council on July 18, 2023, and signed by the County Executive on July 24, 2023. As a result, the effective date of this law is October 23, 2023 (i.e., 91 days after County Executive approval). However, Bill 15-23 states that new rent control requirements “must not apply, and must not be enforced,” until enabling regulations are adopted.
Bill 15-23 requires the Department of Housing and Community Affairs to submit proposed regulations within “3 months after the effective date” – which could be any time between now and January 23, 2024. Once submitted, the County Council must approve the regulations before they become effective. Not knowing when the regulations will be effective – or what they will say – will continue to create some uncertainty as to the interpretation and implementation of this law.
