The Consumer Financial Protection Bureau (CFPB) recently issued a policy statement in which it relies on statutory analysis and past enforcement actions to provide a framework for determining what constitutes abusive conduct under the Consumer Financial Protection Act of 2010 (CFPA).

In this webinar, we will explore the policy statement and the conduct the CFPB generally finds abusive. We will address:

  • The policy statement and its implications;
  • Past enforcement actions in which the CFPB found abusive conduct;
  • Whether there is a significant distinction between abusive and unfair or deceptive acts and practices;
  • The relationship between “dark patterns” and abusive conduct. For more detailed information about dark patterns, please register for our webinar entitled "Shining a Bright Light on Digital Dark Patterns" which is scheduled for next Wednesday, August 16 at Noon ET. Register Here;
  • Conduct that the CFPB might find abusive; and

Best practices for avoiding abusive acts and practices.
