Construction Contracting

One of the most pronounced strengths of our nationally recognized real estate team is its experience in contract drafting and negotiation. We work with AIA, AGC, EJCDC, and other types of construction and design documents, tailoring them to meet client needs. Our experience with public projects enables us to analyze effectively bid packages and proposals, navigate bidding requirements, and handle procurement, Davis-Bacon, and union issues.

Construction Permitting

Our land use and environmental groups assist clients in obtaining the approvals necessary to break ground in a broad range of construction projects. We help clients secure zoning and land-use entitlements and relocate infrastructure. Our attorneys are experienced with underground storage tank removal, wetlands permitting, remediation, and other environmental issues.

Construction dispute avoidance and resolution

We represent owners, lenders, contractors, manufacturers, and design professionals in mediation, arbitration, and other forms of dispute resolution and avoidance. Our practice is active in state and federal courts, including the U.S. Court of Federal Claims, and before all types of building, zoning, and advisory boards. Our construction litigators have been instrumental in developing the most recent rules of the American Arbitration Association.

We also provide litigation support during the development process, including issues relating to solid-waste, air and water permitting, landfill issues, and underground storage tanks. We assist clients with creating project-specific, litigation-ready record management systems for construction projects. We implement advanced document management methods in litigation to control costs of discovery and trial preparation.
