Recently concluded representations in consumer class actions include:

  • Defended an automobile manufacturer in a month-long jury trial of an action alleging consumer fraud in connection with the sale and servicing of 8,000 motor vehicles. The jury found for the plaintiffs on only one claim, limiting damages to less than one-tenth of the damages sought. The entire class damages verdict was subsequently overturned on post-trial motions, resulting in an individualized damages process.

  • Represented manufacturers of appliances and electronics in suits claiming product defects, and a beverage maker in a suit alleging that a drink developed as all-natural is not.

  • Represented several automobile manufacturers in class actions alleging product defects. Our most recent victory was defeating class certification in multidistrict litigation arising from the sale and marketing of OnStar services.

  • Defended a major cable company in a consumer and small business class action alleging that high-speed Internet service was not delivered as promised. After obtaining dismissal of the consumer claims, we achieved a settlement of the putative business class representative's claim on an individual basis.

  • Represented a major home-shopping network in a class action suit in federal court in California claiming that, in promoting goods, the network misrepresented comparable retail values. We defeated class certification.

  • Secured a defense verdict as lead counsel in a four-week jury trial in California state court against an automobile manufacturer, defeating consumer fraud and false advertising claims brought under California statutes that allow such claims to be brought on behalf of the public. The suit sought rescission and injunctive relief, including corrective advertising, for an entire automotive product line.

  • Defeated class action certification in cases brought by consumers of wireless telephone service in rollover minutes and excess fee cases.

  • Represented a restaurant in a suit alleging violation of a statute regarding menu pricing.

  • Represented a major software company in a suit alleging violation of a privacy statute.
