Endless negotiations without litigation often characterize Superfund matters. We work to avoid that outcome because we believe in settling cases that should be settled. Those that cannot we treat as lawsuits and resolve efficiently through litigation. Among our more significant reported Superfund decisions are:

  • Agere Systems, Inc. v. Advanced Environmental Technology Corporation,  2008 U.S. Dist. LEXIS 91887 (Aug. 18, 2008)
  • Raytheon Constructors, Inc. v. Asarco Incorporated, 368 F.3d 1214 (10th Cir. 2003)
  • Agere Systems, Inc. et al. v. Advanced Environmental Technology Corp., et al., 602 F.3d 204 (3d Cir. 2010)
