Our environmental attorneys collaborate with the firm's Energy and Project Finance Group to help clients develop, sell, acquire, invest in, or finance all forms of energy projects and operations.

Our services include:

  • assisting in the acquisition of environmental permits and siting approvals
  • undertaking litigation to challenge unacceptable permit terms or to defend third-party challenges to project approvals
  • evaluating the viability of projects through environmental due diligence
  • negotiating project agreements that allocate environmental responsibilities, obligations, and liabilities among participants

We have integrated our capabilities in climate change and sustainability into the energy project area.  Our experience is wide ranging.  It spans our representation of some of the world's leading climate change scientists as amici before the U.S. Supreme Court in the landmark case Massachusetts v. EPA, which addressed the federal government's authority to regulate carbon dioxide emissions under the Clean Air Act, as well as our counsel to corporate and public entities on developing climate change strategies and policies. Our counsel in this area includes strategies and obligations for reducing greenhouse gas emissions and capitalizing on opportunities to gain financial benefit from reducing these emissions.

Our project experience includes:

  • all forms of traditional fossil fuel-based projects
  • alternative energy projects, including many varieties of waste-to-energy projects and biomass, wind or solar and other renewable energy projects
  • nuclear power projects

These services extend to clients with operations supporting electric generation, including coal mining, oil and gas wells, and natural gas terminals and transmission lines.
