Amy Schwartz is a skilled advocate and litigator who represents clients in banking litigation, complex commercial litigation, and employment matters.

In her banking litigation practice, Amy represents financial institutions in retail branch disputes involving deposit accounts and other payment methods. Amy has particular experience defending banks in disputes arising under Articles 3, 4, and 4A of the Uniform Commercial Code (UCC). Amy also handles cases involving consumer fraud, conversion of negotiable instruments, and the Electronic Funds Transfer Act.

In her commercial litigation practice, Amy represents businesses and individuals in a variety of complex commercial litigation disputes, including claims relating to financial fraud, shareholder disputes, and general contract disputes. Amy has significant experience finding practical, common-sense solutions to seemingly intractable problems.

In her employment practice, Amy counsels clients on all stages of employment matters ranging from policy formation to internal investigations to trials. Among other things, Amy handles compliance with federal, state and local labor and employment laws, leave management, disability accommodations, restrictive covenants, hiring and terminations, and disciplinary proceedings.

  • Peter E. Shapiro, P.A. v. Wells Fargo Bank, N.A., No. 18-CV-60250 (11th Cir. 2019), dismissal of wire transfer claim affirmed by the Eleventh Circuit Court of Appeals
  • Roxanne Shanedling v. Wells Fargo Bank, N.A., et al., No. 27-CV-16-2717 (Dist. Ct. Minn. 2017), summary judgment in favor of the defendant on banker fraud claim
  • Jomari Alexander v. Wells Fargo Bank, N.A., No. 27-CV-15-3304 (Dist. Ct. Minn. 2016), obtained zero liability verdict in favor of the defendant at bench trial
  • Northeast Bank v. Wells Fargo Bank, N.A., No. 14-2240 (8th Cir. 2015), obtained reversal of District Court order and zero liability result for the defendant
  • Patrick Finn and Lighthouse Management Group, Inc. v. Alliance Bank, et al., No. A12-1930; A12-2092 (Minn. 2015), amicus curiae

Commercial Litigation

  • Association for Government Accountability v. Minnesota House of Representatives, et. al, No. 62-CV-17-3396 (Dist. Ct. Minn. 2017), obtained favorable order for the Minnesota House of Representatives dismissing petition for writ of mandamus
  • Hendlin, Inc. v. Appmosphere, Inc., No. 27-CV-14-20744 (Dist. Ct. Minn. 2016), obtained judgment in favor of the plaintiff on a breach of contract claim
  • Obtained favorable settlements for numerous bank clients in complex residential mortgage backed securities litigation
  • Successfully litigated numerous real estate and construction disputes
  • Successfully litigated shareholder disputes

Employment Advising, Investigation, and Litigation

  • Wells Fargo Insurance Services USA, Inc. v. Angelo Galioto and the Kansas City Series of Lockton Companies, LLC, No. A19-0175 (Minn. Ct. App. 2019), obtained reversal of district court order regarding consideration for a restrictive covenant
  • Investigated allegations of legislator misconduct on behalf of the Minnesota House of Representatives
  • Successfully handled charges of discrimination filed with state and federal agencies
  • Successfully litigated discrimination lawsuits
  • Obtained favorable result for defendant employer in FLSA class action
  • Obtained favorable result for employer in workers’ compensation matter
