Elizabeth Schilken has litigated a variety of intellectual property disputes, focusing on claims of copyright infringement, trademark infringement and breach of implied-in-fact contract (idea submission). She also has extensive experience litigating matters of misappropriation of name and likeness/right of publicity, defamation, unfair competition, breach of confidence, breach of fiduciary duty, and interference with contract. Prior to becoming a lawyer, she worked as a newspaper reporter and editor.

Representative Matters

  • Obtained dismissal of defamation and false light invasion of privacy claims against Annapurna Pictures involving the motion picture American Hustle.
  • Obtained dismissal of right of publicity and related claims against Local TV, LLC and Local TV Finance, LLC involving use of video broadcast segments featuring former technology reporter at KTLA.
  • Defended General Motors LLC against copyright infringement and 17 U.S.C. §1202 claims involving photograph of mural.
  • Defended American Broadcasting Companies, Inc. against breach of confidence and breach of implied-in-fact contract claims in connection with the television program American Inventor.
  • Pursued claim in arbitration for breach of motion picture financing agreement for Ambush Entertainment, LLC.
  • Obtained summary judgment in favor of producers of motion picture The Killer Inside Me in dispute over remake rights to underlying novel.
  • Defended Merv Griffin Entertainment, Inc. against breach of implied-in-fact contract claim over television game show Merv Griffin's Crosswords.
  • Defended Hollywood Media Corp. against trademark infringement and dilution claims involving use of domain name.
