Amy L. Schwartz is the Co-Leader of the firm’s Retail Customer Litigation Team. Amy represents financial institutions in retail branch disputes involving tort claims, bank accounts, and payment methods. She has particular experience defending financial institutions in disputes arising under Articles 3, 4, and 4A of the Uniform Commercial Code (UCC) and the Electronic Funds Transfer Act (EFTA), as well as claims involving consumer fraud, defamation, and professional negligence. Amy has successfully tried cases before judges, juries, and arbitration panels, and has successfully handled appeals in both federal and state appellate courts.

In her commercial litigation practice, Amy represents businesses and individuals in a variety of complex commercial litigation disputes, including claims relating to financial fraud, claims against financial advisors, shareholder disputes, and general contract disputes. Amy has significant experience finding practical, common-sense solutions to seemingly intractable problems.

  • Margaret L. Cantlon, et al. v. Wells Fargo & Co., No. 78629 (Nev. 2020), answering certified questions on application of NRS 11.290 in favor of bank
  • Peter E. Shapiro, P.A. v. Wells Fargo Bank, N.A., No. 18-CV-60250 (11th Cir. 2019), dismissal of wire transfer claim affirmed by the Eleventh Circuit Court of Appeals
  • Roxanne Shanedling v. Wells Fargo Bank, N.A., et al., No. 27-CV-16-2717 (Dist. Ct. Minn. 2017), summary judgment in favor of the defendant on banker fraud claim
