Matthew Lamb is a litigator with a practice emphasis in the areas of mortgage banking and commercial real estate. He regularly defends financial institutions in actions involving state and federal lending statutes and consumer protection laws, such as the Real Estate Settlement Procedures Act (RESPA), the Fair Debt Collection Practices Act (FDCPA), and the Truth in Lending Act (TILA).
Matt has extensive experience in both state and federal courts litigating residential mortgage disputes and quiet title actions, and he has obtained dismissals for mortgage lenders in many such cases.
He has also represented special servicers and receivers in receivership actions involving commercial real estate.
Practice Highlights
- Successfully defended mortgage lenders’ security interests in quiet title actions by real estate speculators who purchased residential properties at HOA foreclosure sales
- Successfully litigated Sale of Goods and Lease of Goods disputes arising under Articles 2 and 2A of the Uniform Commercial Code
- Briefed appellate matters before the Nevada Supreme Court, the Ninth Circuit Court of Appeals, the North Carolina Court of Appeals, and appeals of administrative decisions to governing district courts
Before joining Ballard Spahr, Matt Lamb worked in the Office of the City Attorney in Charlotte, N.C., where his practice focused on civil and municipal litigation.
