Craig C. Hoffman is a litigator who focuses on the efficient resolution of disputes to allow his clients to concentrate on the management and growth of their businesses. Craig has an array of litigation experience across numerous industries and has handled disputes ranging from relatively modest dollar amounts to claims worth hundreds of millions of dollars. In consultation with his clients, Craig plans a litigation approach based on his clients’ goals, which may include attempting to achieve a swift resolution of the dispute or preparing for a successful trial and potential appeal.

Craig has extensive civil litigation experience, with an emphasis on disputes involving contract breaches, business torts, distressed real estate and mortgages, deficiency actions, securities litigation, and government investigations. He also has experience defending clients against class actions. Craig handles every aspect of litigation, including initial pleadings and early case-dispositive motions, written discovery, depositions, mediations, motions for summary judgment, presenting oral arguments in court, and trying cases and arbitrations.

Craig also devotes a substantial part of his practice to representing financial institutions, including mortgage, auto loan, and servicing institutions. These matters include representations involving Truth in Lending Act (TILA), Fair Credit Reporting Act (FCRA), and Fair Debt Collection Practices Act (FDCPA). In addition, Craig has extensive experience litigating Telephone Consumer Protection Act (TCPA) matters, including putative TCPA class actions.  

Representative Matters

  • Represented a lender in an action against a borrower to recover deficiency after the borrower’s default on a construction line of credit, obtaining favorable settlement
  • Achieved dismissal of numerous lawsuits filed by residential borrowers against lenders alleging impropriety of trustee’s sales of residential properties and related claims brought under the Truth in Lending Act (TILA) and Fair Debt Collection Practices Act (FDCPA)
  • Successfully represented a satellite television company in multiple Telephone Consumer Protection Act (TCPA) putative class actions
  • Achieved dismissal of a lawsuit brought by a student group against a state university board of regents alleging violations of the student group’s constitutional rights
  • Successfully defended an employer in arbitration against a job applicant’s allegations of religious and age discrimination
  • Obtained favorable settlement on behalf of a financial institution in a dispute regarding alleged mismanagement of a customer’s investments
  • Represented a health care provider in a dispute with a health insurance company over scope of reimbursement obligations
  • Successfully briefed and argued for decertification of an existing class action and defeated a subsequent motion for class certification
  • Represented a satellite television company in suits brought by a minority investor seeking to halt various transactions, obtaining a dismissal in part and resolving remaining claims on the eve of trial
  • Obtained a temporary restraining order for an electronic-content delivery provider prohibiting one of its competitors from hiring the client's key personnel; a favorable settlement was reached before issuance of a preliminary injunction
  • Represented a health care provider and certain of its former executives in a securities class action, derivative case, and an SEC investigation relating to its disclosure of Medicare outlier payments
