Mark Enslin is a trial lawyer representing businesses and individuals in a variety of complex commercial litigation disputes, including those related to securities and financial fraud, contractual disputes, employment disputes, partnership and shareholder disputes, and intellectual property and trade secret issues. He has successfully represented clients in both state and federal court, as well as in arbitrations, and in numerous appeals.

Mark regularly helps businesses and individuals resolve disputes involving fraud and fiduciary duty claims as well as cases involving shareholder disputes. Mark also has significant experience representing trustees in bankruptcy claw-back actions as well as representing special litigation committees investigating shareholder derivative claims.

Representative Experience

  • Obtained summary judgment on behalf of bankruptcy trustee in fraud transfer adversary proceeding in which more than $150 million in encumbrances were set aside in In re Polaroid (Stoebner v. Ritchie Capital Management, L.L.C., 472 B.R. 22 (Bankr. D. Minn. 2012); successfully represented trustee on subsequent appeal to the district court in Ritchie Capital Management, L.L.C., v. Stoebner, 2014 WL 1386724 (D. Minn. Jan. 6, 2014); successfully represented trustee on subsequent appeal to the Eighth Circuit in Ritchie Capital Management, L.L.C., v. Stoebner, 779 F.3d 857 (8th Cir. 2015)
  • Successfully represented financial institution in massive shareholder dispute that involved state court claims, arbitration claims, and numerous state and federal regulatory matters; obtained vacation of arbitration award on behalf of same financial institution in Owens v. VFSC, Inc., et al
  • Represented clients in numerous cases involving shareholder disputes, including recently representing special litigation committee investigating shareholder derivative claims concerning public company
  • Defended brokerage firms in numerous cases related to the sale of TIC investments in both FINRA arbitrations and state court matters
  • Negotiated successful settlement with the SEC on behalf of an individual in a multi-million dollar insider trading case
