Kyle A. DeThomas’ practice focuses primarily on land use, zoning, and development of multifamily and condominium properties. He has experience in a broad range of real estate and construction matters, including financing, sustainable design, title and survey matters. Kyle has drafted and/or negotiated entitlement applications, construction easement agreements, due diligence memorandums, purchase and sale agreements, rental agreements and leases, property management agreements, and warranty claim settlement agreements for projects located in Maryland, Virginia, and Washington, D.C.

As a law clerk for the City of Chicago’s Building and License Enforcement Division, Kyle drafted complaints, court orders, and coordinated efforts among corporate counsel, community groups, and City agencies to reclaim and revitalize neighborhoods affected by the 2008 mortgage crisis.

Prior to entering law school, Kyle served as a Captain in the U.S. Air Force and civil engineer on deployments to Iraq and Afghanistan, and was the chief of development and planning for $1billion in assets, including housing for all Department of Defense personnel stationed in Okinawa, Japan.

Recent Representative Matters

  • Representing a Real Estate Investment Trust in restructuring ownership and establishing reciprocal easement agreements to redevelop a 7-acre office complex with 472 residential rental apartments and the future Crystal City central park in Arlington County, Virginia.
  • Representing a regional developer in the registration of a shelf condominium regime for 325 apartments within a $90 million mixed-use project anchored by a national grocery store chain in Washington, D.C.
  • Representing individual homeowners in securing variances to zoning requirements from the Montgomery County Board of Appeals in connection with the modernization of a historic residence in Chevy Chase, Maryland.
  • Representing a regional developer in the registration of 104 for-sale luxury residential condominium units within a Leadership in Energy and Environmental Design (LEED)-certified public-private mixed-use project in Rosslyn, Arlington County, Virginia.
  • Representing an owner in negotiating reciprocal easement agreement terms for a purchase option under a labor union headquarters lease for premises comprising a portion of a trophy office building in downtown Washington, D.C.
  • Representing a nonprofit think-tank in the negotiation of a new 50,000 square foot headquarters lease in NoMa, Washington, D.C.
  • Representing private equity companies in connection with the acquisition and leaseback of an office complex with 28 acres of undeveloped land in Reston, Virginia, and the refinancing of a 389-condo development in Washington, D.C.
  • Representing an institutional lender in a $600 million construction financing for a mixed-use development in Brooklyn, N.Y., and in a $327 million financing for the adaptive re-use and condominium conversion of the historic Tribune Tower in Chicago.
