Lindsay C. Demaree is an associate in the firm's Litigation Department, focusing on consumer financial services litigation and construction litigation. She regularly defends financial institutions and other creditors in individual and class action lawsuits involving the Fair Credit Reporting Act, the Telephone Consumer Protection Act, the Electronic Funds Transfer Act, the Fair Debt Collection Practices Act, state laws, and lien disputes. In addition, Lindsay has experience negotiating and litigating contract- and tort-based construction claims.

Representative Matters

  • Obtained voluntary dismissal of class action lawsuit alleging violations of the Telephone Consumer Protection Act
  • Successfully moved to dismiss, with prejudice, class action lawsuit claiming impermissible credit pulls under the Fair Credit Reporting Act
  • Lead attorney representing property owner in construction dispute with contractor and architect
  • Successfully enforced arbitration provisions, over opposing party’s objections, to obtain dismissals of individual and class action lawsuits
  • Successfully moved to dismiss quiet title and declaratory relief claims in state court lien dispute action
  • Obtained voluntary dismissal of named plaintiff’s claims in class action lawsuit alleging violation of the Telephone Consumer Protection Act
  • Successfully prosecuted mortgage lender's petition to overturn mediation decision so lender could foreclose on its collateral
  • Played a key role in drafting jury instructions, trial briefs, and post-trial motions in $2 billion pharmaceutical product liability case that resulted in a full defense jury verdict for client
  • Defended individuals against business tort claims arising from a dispute over the Skywalk, the glass bridge overlooking Grand Canyon West
  • Played a prominent role in defending a tire manufacturer against double wrongful death claims
  • Represented a financial management company in an interpleader action, successfully recovering attorneys' fees for her client over the objections of three other parties
