Thomas F. Burke focuses his practice on internal investigations, regulatory compliance, and government enforcement defense. Tom joined the firm in 2015 after federal district and appellate clerkships and a four-year term at the New York County District Attorney's Office. As an assistant district attorney, Tom tried fourteen felony cases to verdict and supervised long-term investigations into narcotics trafficking, identity theft, and embezzlement. Tom also has expertise in complex federal constitutional law and statutory construction.

Tom's practice builds upon his extensive experience with federal and state litigation and includes the following:

  • Providing clients with strategic advice on proactively reducing exposure to federal and state investigations;
  • Negotiating favorable non-public resolutions with the CFPB and DOJ in investigations relating to the Fair Credit Reporting Act, the Fair Debt Collection Practices Act, and the False Claims Act;
  • Supervising early-stage fact-gathering and document production in complex commercial and regulatory enforcement matters;
  • Developing constitutional and statutory legal theories in connection with dispositive motion practice and trial; and
  • Drafting appellate briefs before federal and state courts of last resort.

Pro Bono Experience

Tom maintains an active pro bono practice. He has provided hundreds of hours of litigation assistance in a variety of state-level forums, including Philadelphia Family Court, the Court of Common Pleas, and Pennsylvania Superior Court. He has also advised non-profit clients on federal and state constitutional and statutory questions.
