Allison Phillips Belnap concentrates her practice in the development of residential, hospitality, and commercial real estate with a primary focus in luxury resort, condominium, and planned community development. Her expertise includes:

  • Land acquisition and disposition;
  • Zoning, land use, and entitlements;
  • Homeowner and condominium association creation and governance;
  • Condominium development;
  • Public and private resort development;
  • Creation and governance of mixed-use properties;
  • Development of planned communities;
  • Design and construction agreements; and
  • Other commercial real estate and development matters.

Allison also has experience with timeshare development and registration as well as regulatory compliance and response to consumer complaints and with natural resource matters, including title examination, due diligence, and the leasing of oil and gas rights.

Before attending law school, Allison was a professional actor and director and taught acting, directing, and theatre for young audiences as an adjunct faculty member at Brigham Young University. From 2014 until she joined Ballard Spahr in 2017, Allison took a break from private law practice and served as an Assistant Dean of the J. Reuben Clark Law School, Brigham Young University.

Representative Matters

  • Lead associate in diligence, zoning, entitlement, and other matters related to the acquisition of 13,000 acres to be developed into a private mountain resort
  • Lead associate in luxury resort condominium projects, including acquisition, construction contracts, land use and planning permits, and approvals
  • Lead associate in commercial property acquisition followed by construction and leaseback financing agreements
  • Lead associate in subdivision and development of single-family home communities, including creation and governance of a community association
  • Lead associate in negations and diligence related to the purchase and sale of multi-family properties
  • Supporting attorney in lease drafting and negotiations for class A office properties and large warehouse facilities
  • Supporting attorney in timeshare acquisition and merger transactions

Pro Bono Experience

  • Termination of parental rights and adoption of minors by guardians or stepparents
  • Representation of transgender parent fighting for custody of his child on appeal
  • Park City Tuesday Night Bar, a pro bono program to assist low-income residents with legal issues and provide increased access to justice
  • Rainbow Law Clinic, a clinic for the LGBTQ+ community hosted at the Utah Pride Center and sponsored by the University of Utah's law school
  • Easement negotiations for the Salt Lake City Buddhist Temple
