Adam Ballinger's practice includes working in the areas of fraud and insolvency with an emphasis on Ponzi scheme-type frauds. Adam represents debtors, creditors, trustees, and court-appointed receivers in all matters both in bankruptcy proceedings and outside of bankruptcy proceedings including state and federal courts, mediation, and arbitration. Adam also represents both buyers and sellers of agricultural products in agricultural and food products litigation in both court and arbitration, including the National Grain and Feed Association.

Representative Matters

Fraud

  • Specifically Ponzi schemes, including the Thomas Petters Ponzi scheme
  • Multimillion dollar malpractice cases against professionals
  • Large fraudulent transfer cases to recover stolen funds
  • Coordinated recovery efforts in foreign countries including Bermuda, the British Virgin Islands, and the Cayman Islands
  • Managing the intersection of receivership cases, bankruptcy cases, criminal proceedings, and criminal and civil forfeiture proceedings which, in one instance, culminated in a Coordination Agreement between a receiver, two bankruptcy trustees, and the United States Department of Justice

Financial Restructuring & Bankruptcy

Adam commonly represents both unsecured and secured creditors in all bankruptcy proceedings including:

  • Seeking relief from the automatic stay
  • Defending and enforcing security interests and liens in collateral
  • Representing creditors' interest with respect to their claims filed in the bankruptcy case
  • Many cases involving fraudulent transfer and preferential transfer issues on behalf of bankruptcy trustees, trade creditors, unsecured creditors, and secured creditors
  • Defended the buyer of an interest in a limited liability company in a sale under Article 9 from claims by a bankruptcy trustee alleging it was a fraudulent transfer

Agricultural and Food Contracts Litigation

  • Obtaining and collecting a $600,000 arbitration award in favor of a grain buyer against a grain producer in a proceeding before the National Grain and Feed Association
  • Successfully defending a National Grain and Feed arbitration award before the North Dakota Supreme Court
  • Obtaining a judgment in a bench trial on behalf of a grain buyer in a breach of contract dispute
