Ms. Shapiro-Cyr and the panel will delve into the wonderful world of “shudda-wudda-cudda” to identify issues that should have been addressed differently (or not at all) in the art and science of shopping center leasing. They will examine lease provisions that fall short of the goal of making clear the parties’ intent, including discussing unintended consequences, technological changes, and changes in custom and practice. They will also discuss changes that might need to be made to lease forms in order to accommodate financing in the present (and future) economic environment.
