Recently the FBI began a public campaign regarding trade secret theft titled “$13 Billion Lost, Protect America’s Trade Secrets.” The purpose of the unusual campaign was to draw attention to the growing problem of state-sponsored and private espionage targeted at U.S. companies. In the interim, trade-secret civil cases are rising, and in May 2012, the Delaware Supreme Court blocked a hostile takeover attempt because the company that sought to pursue the deal used confidential information obtained legally during prior friendly merger discussion.

Ms. Jaffari will moderate a panel whose members will review recent criminal and civil trade secret cases, including increased EEA prosecutions and the appropriate methods of obtaining corporate intelligence. They will summarize the latest considerations in the evolving field of trade-secret protection and competitive intelligence that is now under greater scrutiny by the government and courts.
