In response to the current distressed real estate market, Ballard Spahr Andrews & Ingersoll, LLP has formed a distressed real estate team that will provide clients with assistance in all types of real estate restructuring and bankruptcy matters.

Several Ballard lawyers will share their notable experience in the distressed real estate market at the Information Management Network's (IMN) Second Symposium on Distressed Real Estate, June 26-27, at The Bellagio in Las Vegas.

Roger Winston, managing partner of Ballard's Bethesda, Maryland office, practice group co-leader of the Planned Communities and Condominiums Group and member of the firm's Real Estate Department, is session chair of the panel "Business Operational and Legal Strategies to Transform Distressed Condos into High Performing Investments."  The panel will examine state law requirements and developer definition, condominium regime termination issues, developer/lender liability, fiduciary responsibilities of successor developers, tax issues of fractured condominiums, and funding and recapitalizing.

Kelly Wrenn, from the firm's Washington, D.C., office and also a partner in the Real Estate Department, will serve as a session chair on "The Role of Servicing and Special Servicing for Distressed Loans."  This panel will explore the interaction of borrowers with servicers, rating agency impact, servicer and special servicer agreements, and communications and reporting.

David Barksdale, resident in the firm's Las Vegas office and a partner in the Real Estate Department, is a featured speaker on the panel presentation "Project-Level Workout Issues."  The panel will discuss trustee issues, private equity and hedge fund acquisition issues, commercial mortgage litigation, special servicing, troubled partnership and joint-venture workouts, lender liability, and how to enforce bad-boy agreements.
