In the matter of Spring Glen Apartments LLP v. Arch Specialty Insurance Company, a North Dakota federal court ruled that an apartment complex was covered for water damage from a cracked water main even though its insurance policy does not cover the pipe itself. U.S. District Court Judge William G. Young found that while Spring Glen's policy excludes claims for wear and tear to pipes, it also specifically allows claims for damage caused by water leaking from those pipes, overriding an exclusion for underground water damage.
