A federal judge in Arizona overseeing RPost Communications Ltd.’s patent suit against GoDaddy.com Inc. tossed the patent holding company's expert damages report Tuesday. The judge said the expert’s analysis was grounded in "speculation and conjecture."

In strong and at times colorful terms U.S. District Judge James A. Teilborg said no reliable and tangible evidence supports the royalty rates selected by RPost expert Gregory Smith.

Judge Teilborg said certain damages calculations were based on "completely irrelevant" information and others seemed "plucked ... out of thin air."

"The arbitrariness found in Mr. Smith’s conclusions violates Federal Circuit precedent," Judge Teilborg wrote.
