Warner Chilcott PLC on Wednesday ripped Mylan Pharmaceuticals Inc.’s bid to revive a suit accusing Warner of blocking generic competition, saying a recent brief Mylan filed with the Third Circuit contains “whopping misstatements” and unfounded accusations.

Warner Chilcott asked the appeals court to allow it to file a surreply to Mylan’s Feb. 9 reply brief in order to respond to the “extraordinary and unfounded accusations” that Warner misstated the record and raised new arguments on appeal. Warner said that “whopping misstatements” made in Mylan’s reply brief justify its request to file the extra brief.
