A Pennsylvania U.S. District Judge Mary A. McLaughlin ruled against consumers and wholesalers Wednesday who claimed that GlaxoSmithKline paid off generic rivals to keep cheaper versions of antidepressant Wellbutrin XL off the market. She determined that buyers couldn't show that the settlements that let the patent challenge continue violated antitrust law.

Judge McLaughlin granted GlaxoSmithKline PLC summary judgment in the pay-for-delay antitrust suit over a 2007 settlement GSK and Wellbutrin patent owner Biovail Corp. reached with several generic-drug makers.

GSK is represented by Stephen Kastenberg, Leslie John, Ed Rogers, Jason Leckerman, Jessica Anthony, Marcel Pratt and Barbara Schwartz of Ballard Spahr LLP.
