A Nevada federal judge has tossed a private clinic’s suit accusing GlaxoSmithKline LLC, nonprofit Apexus Inc., and a public health agency of abusing a federal drug discount programs, ruling that the agency’s purchase of vaccines was exempted from an antitrust law.

U.S. District Judge James C. Mahan granted the defendants’ motions for summary judgment, rejecting The Vaccine Center LLC’s argument that the Southern Nevada Health District bought reduced-price vaccines intended for low-income patients but resold them to the general population.
