Calling its accuser a "serial antitrust litigant," DuPont Co. has asked a Colorado federal court to dismiss an antitrust suit claiming it conspired with one of its auto paint wholesalers to offer steep discounts and steal the rival wholesaler's customers. The original complaint, filed in December 2011, claims DuPont gave the rival unfair advantage and undercut competition in the automotive coatings market.

DuPont's position is that it could not have financially benefited from such an alleged scheme. Ballard Spahr litigators K. Allison White, Roger P. Thomasch, David M. Stauss, and Stephen J.
