The U.S. Supreme Court will look a case that will determine the validity of recess appointments made by President Obama. National Relations Labor Board v. Noel Canning could call into question the legitimacy of other appointments that the president has made in recess, such as his appointment of Richard Cordray, Director of the Consumer Financial Protection Bureau.

Alan S. Kaplinsky, Practice Leader of Ballard Spahr's Consumer Financial Services Group, explained the ramifications that such a ruling could have. Referencing the potential impact of the ruling against Obama's recess appointments, Mr. Kaplinsky said, “There will be a cloud of uncertainty hanging over every action taken by Richard Cordray.”
