In an effort to comply with ever-increasing regulation, in-house sub-servicing for providing specialty and default mortgage servicing is gaining popularity. Stricter government lending requirements and stepped-up regulatory oversight have caused small servicers to struggle with traditional sub-servicers, and the mortgage banking industry is responding.

In announcing the recent creation of Ballard Spahr's collection documentation task force, partner Christopher Willis noted that governmental agencies and consumer advocacy groups are expressing growing interest in this issue. With the task force, the firm aims to assist clients with rapidly increasing documentation-related scrutiny of the foreclosure process.
