A team of Ballard Spahr attorneys won a significant federal court ruling when the judge sided with senior creditors in a battle with a mezzanine-loan holder over control of the JW Marriott Starr Pass Resort in Tucson, Arizona.

Ballard Spahr partner Timothy F. McCormack, representing the senior lender, successfully argued that his client was concerned that if the mezzanine lender won control, it might try to force loan modifications that the senior creditors don’t want, possibly by forcing the borrower into bankruptcy.
