A Coconino Country Superior Judge is expected to rule today on whether a civil suit, filed by the Hopi Tribe against the city of Flagstaff, will go to trial. The Hopi Tribe contends that Flagstaff is violating state law by selling treated effluent to a ski resort. Attorneys representing Flagstaff argue that the Hopi Tribe is only looking to stop development of the ski resort.

“This is plan B in the litigation strategy. They had a plan A; they lost. I’m sure that plan C will be to sue Snowbowl,” said John Kerkorian, a partner with Ballard Spahr.
