Budget cuts to Arizona’s health care system for the poor has prompted a lawsuit against the state claiming that a proposition passed by voters in 2000 requires the system to provide free care to everyone below the federal poverty level. But Ballard Spahr partner Joseph Kanefield, who is representing the health care system, argued that the state can scale back the program because of the budget situation, and that the court cannot legally second-guess the decisions made by the governor and Legislature.
