California's Regulation of Commercial Finance: The Impact of SB 1235 and Its Implementing Regulations

The California Department of Business Oversight (DBO) has issued an invitation for comments from stakeholders in developing regulations to implement SB 1235, the new California commercial finance disclosure law enacted on September 30, 2018.

In this webinar, Ballard Spahr commercial finance lawyers will discuss important issues arising from this new law, including:

• The impact of the law on small business loans, merchant cash advances, and other covered products;

• The importance of the DBO’s implementing regulations and the key issues on which industry participants should comment before the January 22, 2019 deadline;

• The risk that other states or Congress may pass similar laws, and which states are most likely to be affected; and

• Potential legal challenges to SB 1235 that industry groups may wish to pursue.
