The Trump administration is likely to bring many changes. For more than 100 years, however, the Federal Trade Commission (FTC) has been a constant and active enforcement presence in all areas of interstate commerce. Regardless of any changes that may take place at the Consumer Financial Protection Bureau (CFPB), the FTC is expected to continue pursuing its mission, which includes protecting consumers from unfair or deceptive acts or practices (UDAP). In this webinar, we will review the enforcement authority of the FTC, survey recent enforcement in the consumer financial services industry, and discuss how companies should prepare for and respond to the FTC.

Topics will include:

  • The FTC commissioners and possible appointments;
  • The FTC Act, including the FTC's UDAP authority as opposed to the CFPB's UDAAP authority, and limits on the FTC's jurisdiction;
  • Other federal laws that the FTC has authority to enforce, including recent enforcement activity under those laws;
  • Proactive engagement with the FTC, including public comments, workshops, and responding to information requests; and
  • What to do when a company receives a FTC civil investigation demand (the first step toward possible enforcement.
