Terminating an individual's employment, negotiating the departure of an executive, designing a reduction in force, or settling a legal claim can be difficult for employers, if done carelessly. In this program, we will review recent legal developments regarding drafting compliant and enforceable termination, separation, and severance agreements. We also will explore the enforcement of waivers of employment claims; compliance with the Older Workers Benefit Protection Act (OWBPA); and the viability and advisability of additional clauses, including non-competition, non-solicitation, and restrictive covenants.
