Because the FTC has not yet promulgated formal regulations governing data security and privacy – but rather regulates by consent decree – it is critical for companies with a significant online presence to understand the FTC's current views and approaches toward various aspects of data privacy and security. Ballard Spahr partners Phil Yannella and Dan McKenna, along with Ballard Spahr Counsel Kim Phan, will provide background on the FTC's central role in regulating data privacy and security and then review recent FTC enforcement decisions, providing their legal assessment of the current risk environment. They will also discuss the FTC's evolving role as the "de facto privacy regulator" as additional federal agencies begin focusing on data privacy and security. Q&A will follow their presentation.
